Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Fisica application and services operated by Care&Co. ("Company", "we", "us", or "our").

1. Acceptance of Terms

By accessing or using the Fisica application ("Service"), you agree to be bound by these Terms. These Terms affect your legal rights and obligations. If you do not agree to all of these Terms, do not access or use the Service.

2. Eligibility and Age Restrictions

To use this Service, you must be at least 13 years old (16 years old for certain jurisdictions including the EU/EEA). By using the Service, you represent and warrant that you meet these age requirements. If you are under the legal age of majority in your country, you must have permission from a parent or legal guardian to use the Service.

3. Medical Disclaimer

This Service does not provide medical advice.

Fisica is a digital healthcare wellness tool. Reports, analysis, and 3D modeling (plantar pressure reports, vision analysis, neural avatars) generated by the Service are provided for informational and educational purposes only.

  • This Service is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or medical condition.

  • Always seek the advice of a physician or other qualified healthcare provider with any questions regarding a medical condition.

  • Never disregard professional medical advice or delay in seeking it because of something you have read on or accessed through the Service.

  • Reliance on any information provided by Fisica is solely at your own risk.

4. Service Description and License

4.1. Device and License Registration

This Service is designed to work in conjunction with the "Fisica Scale" (the "Device").

  • License: Upon purchasing the Device, you are granted a license to use all features of the application by registering the Device’s unique identification information.

  • Limited Access: If a license is not registered or has expired, access to certain features (e.g., detailed plantar pressure reports, measurement history) may be limited.

  • Non-transferable: Unless otherwise specified, your license is personal and may not be assigned or transferred to any third party.

4.2. Trial Mode

The Company may provide a "Trial Mode" for users without a license to test limited features of the Service. These Terms apply equally to Trial Mode users.

5. Fees and Payments

5.1. Payment Methods and Third-Party Processors

The Company provides both in-app purchases through third-party app stores (e.g., Apple App Store, Google Play Store) and direct payments through authorized payment gateways (PG). By proceeding with a purchase, you agree to comply with the terms of such payment processors.

5.2. Subscriptions and Automatic Renewal

If you purchase a subscription-based service, you will be billed in advance on a recurring basis. Your subscription will automatically renew at the end of each billing cycle. If you do not wish to renew automatically, you must cancel your subscription through your account settings or the applicable app store's subscription management at least 24 hours before the renewal date.

5.3. In-App Purchases

For purchases made through the Apple App Store or Google Play Store, the billing and refund process follows the terms of those platforms. The Company does not directly manage or process refunds for in-app purchases.

5.4. Taxes and Currency

Unless otherwise stated, all fees are exclusive of taxes. You are responsible for any sales tax, use tax, value-added tax (VAT), or similar taxes (e.g., GST) applicable based on your location. Payments are processed in the currency displayed at the time of purchase.

5.5. Refund Policy

Except as required by applicable law (e.g., the EU's 14-day right of withdrawal or South Korea's Consumer Protection Act), all purchases are final and non-refundable once the digital content or service has been accessed.

6. Hardware Purchase and Shipping (Fisica Scale)

6.1. Orders and Shipping

By ordering the Fisica Scale, you agree to provide accurate shipping information. Shipping dates are estimates, and the Company is not responsible for delays caused by carriers or customs.

6.2. Customs and Duties

For international orders, you become the "Importer of Record" and are responsible for all import duties, customs fees, and local taxes (VAT/GST) applicable in your country.

6.3. Title and Risk of Loss

Title to the Device and the risk of loss pass to you upon our delivery of the Device to the carrier.

6.4. Hardware Returns and Refunds
  • Unopened Products: You may return an unopened Device within 14 days of delivery for a refund (excluding shipping and restocking fees).

  • Defective Products: If the device is defective upon arrival, please contact us within 7 days of receipt at support@carenco.kr to request an exchange or repair.

6.5. Limited Hardware Warranty

The Company provides a limited warranty against defects in materials and workmanship for a period of one (1) year from the date of delivery. This warranty does not apply to damage caused by accident, misuse, or unauthorized modification.

7. User Accounts and Security

You must provide accurate, complete, and up-to-date information during the registration process. You are responsible for safeguarding your password and agree not to disclose it to any third party and accept full responsibility for all activities that occur under your account. You must notify the Company immediately upon becoming aware of any breach of security or unauthorized use of your account.

8. Data Ownership and Use

8.1. User Content

You retain all ownership rights to the information, data, and photos you upload ("User Content"). However, by using the Service, you grant the Company a worldwide, non-exclusive, royalty-free license to use, host, and analyze this content to provide and improve the Service.

8.2. Use of De-identified and Aggregated Data

You agree that the Company may create, use, and disclose de-identified or aggregated data derived from your use of the Service ("Service Data"). The Company may use such Service Data for lawful purposes, including:

  • AI and Machine Learning: Training, developing, and enhancing AI models and underlying algorithms.

  • Research and Development: Conducting internal research, statistical analysis, and publishing academic or industrial reports.

  • Service Improvement: Improving device accuracy, optimizing performance, and developing new features.

Such data will be processed in a manner that does not personally identify you, and the Company commits not to attempt to re-identify individuals from this data.

8.3. Third-Party Data Sharing

Sharing your personal health data with third parties (e.g., hospitals, labs) will only be done with your explicit and separate consent, unless required by law.

9. Prohibited Conduct

You agree not to:

  • Use the Service for commercial purposes without prior written approval.

  • Interfere with or attempt to interfere with the access of any user, host, or network.

  • Access the Service using robots, spiders, or other automated means.

  • Reproduce, distribute, or publicly display "Measurement Reports" for commercial gain without the Company's consent.

10. Termination

  • Termination by User: You may terminate your account at any time through the application settings. Upon termination, your data will be deleted in accordance with our Privacy Policy.

  • Termination by Company: The Company may immediately terminate or suspend your access to the Service without prior notice for conduct that violates these Terms or is harmful to other users or us.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Care&Co. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use.

The Service is provided "as is" and "as available." We expressly disclaim all warranties of any kind, whether express or implied, including the accuracy of AI-generated body analysis.

12. Governing Law and Jurisdiction

12.1. Governing Law

These Terms are governed by the laws of the Republic of Korea.

12.2. Local Laws

Notwithstanding Section 12.1, if you are a consumer residing in the EU or other jurisdictions with mandatory consumer protection laws, you may have the right to bring claims in the local courts of your country of residence.

12.3. Jurisdiction

Subject to Section 12.2, any disputes related to these Terms shall be submitted to the exclusive jurisdiction of the competent courts located in the Republic of Korea.
